At last night\u2019s Tyrone Township meeting, supervisors approved a settlement agreement between the township and land developer Dale Furry of the Hobbit Hollow Subdivision Plan.
\nTownship solicitor Larry Clapper informed those present at the meeting that the subdivision plan had been put on record by Dale and Shirley Furry back in 1996. Since then, there were numerous amendments made to the plan throughout and leading up to 2001.
\nClapper went on to say that a road was supposed to be put in by the developers, but they did not comply with the plans.
\nEngineer Joe Keller represented Furry in the matter with the township.
\nSince then, the township and Furry have been in an ongoing lawsuit.
\nAccording to Clapper, a settlement was reached where Furry has agreed to make a 4,500-foot long road, 3- feet wide, 1- foot long cartway, two foot shoulders as well as the construction of a cul-de-sac.
\nAlso, the road will be graded and drainage pipes and aggregate will be placed in needed areas. Utility poles will be relocated and a soft spot will be refilled.
\nUpon completion of the project, Keller will give the township the plans and specifications of the road.
\nAfter the township receives the information, the supervisors are willing to consider a new subdivision plan where certain residuary properties can be sold as sidelot divisions in the Furry development. However, this will include no new lots.
\nThe township is then willing to take over and maintain the road as a township road.
\nThe supervisors and Clapper met in a brief executive session before the start of the regular meeting to discuss the settlement.
\nAfter the information was presented to the public in the regular meeting, Supervisor Raymond Paul made the motion to approve the settlement so the township could drop the lawsuit.
