District Magistrate Fred Miller has granted a defense motion requesting a continuance in the drug case involving Tyrone High School senior Sam David Kirk.
\nAccording to a secretary at Miller\u2019s office, the hearing is now scheduled for April 29 at 10 a.m. The added time will allow Kirk\u2019s attorney, Phillip Robertson, time to prepare for the proceeding.
\nKirk was arraigned Friday morning on charges of possession of controlled substances (heroin), possession of drug parpahernalia and a violation of the school code, possession of a telecommunication device during school hours.
\nAccording to an affidavit of probable cause filed by police chief Mark Frailey of the Tyrone Area School District Police Department, a search of Kirk\u2019s person on March 3 revealed a small bag containing a white substance. Subsequently, the substance was analyzed by the state police crime lab and determined to be heroin, a Schedule 1 narcotic.
\nFrailey was tight-lipped about the arrest during a telelphone conversation with The Daily Herald Friday afternoon.
\nHe did say, however, that he wasn;t sure if this paricular incident would lead to future arrests.
\n\u201cWe don\u2019t tolerate heroin here at the school,\u201d said Frailey. \u201cAnytime we find somebody with heroin, we\u2019re going to arrest them.\u201d
\nAlso during the search, a cellular telephone was found in the defendant\u2019s pocket.
