In a special meeting yesterday afternoon, the Northern Blair Regional Sewer Authority voted 5-1 to conditionally approve the 2003 sewer services agreement with Logan Township. The no vote was by chairman Charlie Diehl.
The authority had until 4:30 p.m. on Thursday to accept the agreement, but there is still negotiation to be completed for the contract to take effect.
The authority was in executive session for 45 minutes to discuss the legal matters involved in the new contract. When the public meeting was called back into order, Ray Amato made a motion to accept the new contract if Logan Township accepts the changes in section 2.04 concerning the payment for the expansion of the Logan Township Treatment Plant capacity.
“We want to act in good faith with Logan township,” said Amato. “We want to see the wording of section 2.04 changed. We feel that we have acted in good faith all along in the process.”
The authority voted 5-1 to conditionally accept the agreement. If Logan Township doesn’t accept the changes proposed in section 2.04 by the Northern Blair Regional Sewer Authority, the agreement will not be accepted.
If Logan Township doesn’t accept the changes in section 2.04 the contract would revert back to the 1979 agreement between the authority and Logan Township.
“Our problem is with the numbers,” said Diehl. “Logan Township has a set of numbers that they want the authority to pay and we have numbers that we feel are fair to pay Logan Township. Those numbers probably will need to be compromised.”
If the contract change is not accepted by Logan Township, the final agreement could be decided in the courts.
